New Members
IMPORTANT: At its meeting on 4 November 2009, the Executive Committee of the LOA REACH Consortium decided to close the member admission process as of December 31, 2009. Any eligible company will be able to join though year end. As from 1 January 2010, however, no new members will be permitted to join the Consortium and the membership will be officially closed.
The LOA REACH Consortium will concentrate all of its efforts on finalization and timely submission of the joint registration dossiers.
To allow any interested company to make a decision on whether to join the Consortium, the missing letter of access costs and the Terms & Conditions governing data access will be published on the SIEF management pages shortly. Any eligible company that has submitted a signed Accession Agreement by 31 December 2009, will be able to complete the admission process to join the Consortium.
Membership of the LOA REACH Consortium offers multiple benefits:
An alternative to full membership for some companies may be to
purchase a letter of access to specific items of the Consortium work
product.
Both EU and non-EU manufacturers and importers are invited to join the Consortium as a New Member. New Members have full access to the activities and the resources of the Consortium.
New Members are required to pay their full equal share of the cost of the Consortium. In other words, New Members pay exactly the same as Founding Members towards the Consortium’s general overhead and operational cost and its funding needs.
The criteria for membership and admission are objective. They include the following:
- The candidate member must be (i) a manufacturer, (ii) an importer, (iii) an affiliate of a manufacturer and/or importer, or (iv) a non-EU manufacturer, provided that it is represented by an only representative (as defined in the REACH Regulation).
- It must be involved with one or more substances covered by the Consortium, on their own, in preparations, in polymers as monomers or in articles.
- It must be subject to the registration requirements pursuant to the REACH Regulation in respect of such substances.
Applicants must complete the Annexes of the Accession Agreement (which they do not sign at this point), and submit a signed Confidentiality Agreement. Upon receipt of these materials, the Secretariat conducts a check of completeness and either (i) requests additional information, (ii) rejects the application if the criteria are not met, or (iii) sends an admission package to the applicant.
The admission package includes:
- The Consortium Agreement, including the list of categories and substances;
- The Services Agreement;
- n overview of the past and current costs of the Consortium’s activities, the approved budget for the running year and an estimate of the fees to be paid by the potential member upon joining the Consortium; and
- An unsigned Accession Agreement.
Upon reception of two signed copies of the Accession Agreement from applicant, the Secretariat circulate the application among the members of the Executive Committee. The application is approved in the absence of objections by any members of the Executive Committee. In case of objections, the application is reviewed at the next Executive Committee meeting.
